Abrego Garcia was deported on March 15, 2025, after being erroneously identified as a gang member. During court proceedings, the government acknowledged the deportation resulted from an “administrative error” but contended that his return was not possible because he was no longer in the custody of the U.S.
Judge Xinis emphasized that the deportation lacked legal justification, noting that an immigration judge had previously granted Abrego Garcia withholding of removal—a protection prohibiting deportation to countries where the individual may face persecution. Therefore, his removal to El Salvador was unlawful.
The administration has been given three days to comply with the order.
